Defendant Richard Dillon appeals from the district courts denial of his petition for writ of habeas corpus. While we affirm that courts refusal to hold an evidentiary hearing and its finding that the state trial judges imposition of the death sentence complied with Indiana law, we disagree with the courts conclusion that Dillon received effective assistance of counsel under the Sixth Amendment. Accordingly the writ of habeas corpus must issue if there is no retrial.
